Terms and Conditions: General Usage, Privacy, Course Access, and Liability


1. Acceptance of Terms


By accessing or using our website, attending live webinars, scheduling our services, or purchasing our products, you agree to these Terms and Conditions. If you do not agree, do not use the website, attend webinars, or purchase our services, courses, or products.

  

2. Course and Webinar Access


  • Course Access: When you purchase a course, live webinar, or mentoring session, you are granted a non-exclusive, non-transferable license to access the materials for personal use only. Sharing login credentials or course materials with others is prohibited.
  • Webinar Conduct: During live webinars, respectful behavior is required. We reserve the right to remove participants who disrupt sessions without refund.
  • Mentoring Sessions: Live and recorded mentoring sessions are intended for educational purposes and are not a substitute for professional medical, psychological, or legal advice.

  

3. Working with Children and Adults


  • If you are purchasing or enrolling a child in any course, mentoring, or webinar, you affirm that you are their parent or legal guardian, or that you have obtained proper consent.
  • While we aim to provide supportive and educational content, our services are not intended to diagnose or treat any mental health or medical conditions in children or adults.
  • Parents or guardians must supervise children’s use of all content and services.

  

4. Limitation of Liability


  • Educational Purposes Only: The content provided in our courses, webinars, and mentoring sessions is for educational and informational purposes. It is not a substitute for professional medical, psychological, or financial advice.
  • Mental Health Disclaimer: Our services are not intended for diagnosing or treating mental health or medical conditions. If you or your child has a pre-existing mental health condition or other serious medical concerns, consult a licensed professional before using our products or services. We are not responsible for any adverse effects arising from your use of our materials.
  • General Liability: To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our website, courses, webinars, or mentoring sessions.

  

5. Intellectual Property


All content, including course materials, live webinar recordings, mentoring resources, and website content, is our intellectual property or licensed to The Coakley Center. Unauthorized sharing, copying, or distribution of this material is strictly prohibited.

  

6. Use of Third-Party Tools and Services


  • The Coakley Center may use third-party platforms for hosting courses, processing payments, or facilitating live webinars. By using our services, you agree to their terms and policies.
  • We are not liable for issues caused by third-party platforms, including downtime, errors, or breaches.

  

7. Conduct and Participation


  • Appropriate Use: You agree to use our services respectfully and not engage in behavior that disrupts webinars, mentoring sessions, or other users.
  • Termination of Access: We reserve the right to suspend or terminate access without refund if these terms are violated.


8. Messaging Terms & Conditions


By opting into text message notifications from The Coakley Center, you agree to the following terms:


Message Types:
You may receive SMS messages related to:

  • Appointment reminders
  • Service updates
  • Customer support messages related to your engagement with us


Opt-In Process:
Users must explicitly consent to receive SMS messages by texting START to (980) 319-2195 to The Coakley Center or by using the Contact US opt-in form and writing in the word START before submitting the form. By opting in, you agree to receive SMS messages from The Coakley Center regarding appointments, service updates, and promotions.


Message Frequency:
You may receive up to six (6) messages per month. Frequency may vary based on service updates or engagement with our programs.


Message & Data Rates:
Message and data rates may apply based on your mobile carrier’s plan.


Opt-Out Guidance:
You may opt out of SMS messages at any time:

  • Reply STOP or CANCEL to any message you receive.

We aim to foster a safe, respectful learning environment. Bullying, harassment, or any inappropriate behavior will result in immediate removal without refund.

  

11. No Guarantee of Results


While our webinars, courses, products, and mentoring sessions are designed to educate and inspire, we cannot guarantee specific results, such as improved academic performance, career success, or personal development, as there are many factors outside of our control that influence the outcomes. Success depends on individual effort and circumstances.

  

12. Governing Law


These Terms and Conditions are governed by the laws of North Carolina. Any disputes will be resolved under these laws.

Payment and Refund Policy

Effective Date: August 1, 2023


At The Coakley Center, we are committed to delivering high-quality educational and mentoring services. Please review our payment and refund policy before making a purchase.


1. Payment Terms

  • Full payment is required at the time of purchase to secure access to courses, webinars, or mentoring sessions.
  • Accepted payment methods: major credit cards and PayPal (processed securely).
  • Purchase orders are accepted for corporate contracts and institutional programs. Payment terms must be agreed upon before purchase.
  • Custom agreements are available for bulk purchases, corporate training, or partnerships. Contact info@TheCoakleyCenter.com to discuss customized terms.


2. Refund Policy

We stand behind our services and offer limited refunds under the following conditions:


A. Courses (Digital & On-Demand)

  • Refunds are available within 14 days of purchase, provided: 
    • Less than 15% of course content has been accessed (tracked by login, video progress, or downloads).
    • A valid reason is provided (e.g., dissatisfaction before significant usage).
  • A $10 fee or 10% of the total purchase applies to approved refunds.


B. Live Webinars

  • Refunds are available only if cancellation is made at least 24 hours before the scheduled event.
  • No refunds for missed webinars (recordings may be provided, if applicable).


C. Mentoring Sessions

  • Refunds for mentoring packages are available within 14 days if no more than one session has been completed.
  • Individual sessions are non-refundable once attended.


D. Digital Downloads & Non-Service-Based Products

  • No refunds on digital downloads or instant-access products once accessed or downloaded.


3. Non-Refundable Situations

  • More than 15% of a course has been accessed.
  • Dissatisfaction after significant usage of a service.
  • Missed live sessions/webinars without prior cancellation.
  • Refund requests made after 14 days of purchase.


4. Return Policy (Physical Products Only)

  • Physical items (if applicable) may be returned within 14 days of receipt in unused condition.
  • Defective/damaged items must be reported within 7 days with supporting photos.
  • Customers are responsible for return shipping fees, except in cases of incorrect or defective products.


5. Refund Process & Timeline

  • To request a refund, email info@TheCoakleyCenter.com with: 
    • Order number & purchase details
    • Reason for refund
    • Proof of issue (if applicable)
  • Approved refunds are processed within 7–10 business days to the original payment method.
  • A $10 processing fee or 10% deduction applies to certain refunds (courses/mentoring).
